An attorney I work with is pursuing a lawsuit related to a data breach. The defendant company had poor security and suffered hacking and theft of personal information (SS numbers, etc.) from its customers. Have any of you worked in that area? In particular, is there data out there on consequences of data breaches? Some of the attorney's clients have not experienced damage yet, but there is risk. The question is: what is the risk? A second issue is tying actual damage to the breach. Some of the clients have experienced monetary losses, but what can be done to determine if the loss is due to this specific breach and not to another source. Ideas? Resources? Interest?
